House Judiciary Committee, presided over by Rep. John Conyers
of Michigan, the Ranking Member. Originally published in January,
2005 by the Government Printing Office. Both a riveting and alarming
report on the status of our ailing presidential election process,
this report provides new insights into the abuse and manipulation
of electronic voting machines and the arbitrary and illegal behavior
of a number of elected and election officials which effectively
disenfranchised tens of thousands of voters in order to change

Lawyer Alleges Massive Vote
"Migration" in the Ohio Election

Cliff Arnebeck a lawyer with Alliance for Democracy and the Ohio Common Cause organizations revealed in a televised interview on C-Span on Thursday, December 2nd, 2004 that he is filing a law suit in Ohio that contests the presidential election because of alleged massive switching of votes from Kerry to Bush. Arnebeck, who is supported by a grass roots movement and several non-partisan organizations, is filing a lawsuit that differs dramatically from the grounds of the Green Party’s lawsuit, which is merely to recount the votes. Arnebeck alleges that one possible explanation for the switching of thousands of votes is fraud and wrongdoing in the election. Arnebeck stated categorically thatt if a full and accurate recount that excluded the election irregularities were conducted, it would show Kerry to be the winner. Evidence suggests that votes for John Kerry “migrated“ from Kerry to Bush, doubling Mr. Bush's vote advantage. Arnebeck stated that his efforts are nonpartisan and that he seeks to know the truth, no matter who the winner is. As the Bush Machine rolls on -- through Orwellian "Patriot" Acts, Intelligence "Reforms" and "Clear Skies" Initiatives, adding treason to treason, felony to felony, unconstitutional domestic acts to violations of international law, "crimes against all humankind" to crimes against the biosphere; as it authorizes torture, domestic surveillance, and terms the Geneva Convention "quaint" -- progressive pundits waffle on with exhortations to hopefulness, ideological mea culpas, adjurations to linguistic reframing, advocating emulations of the right, and statistical analyses based on flawed polling and fraudulent vote counts, I find myself wondering: How long are these people going to keep on playing in a rigged game?
The grassroots democratic drama of the 21st century is unfolding in Ohio (not to mention New Mexico, Nevada, and oh yes, the Ukraine), blacked out by the same pusillanimous establishment media that went along with alleged Iraqi WMDs and al qaeda links; blacked out the CIA's role in bringing crack cocaine to the country's ghettos (and apparently drove rare honest journalist Gary Webb to an alleged "two-shot suicide"); and ignored by the flaccid, complicit and supine DNC, Kerry/Edwards camp and Congress. They're all acting exactly like the collusive wife in an abusive relationship.
The progressive strategists and operatives prattle on about the "White Elephant" of the "race factor" in the 2004 election (duh!), but no one seems to notice the gaggle of 500-pound gorillas sitting in the corner of the national living room. Please, look at the data, citizens. The election was stolen -- just like in 2000, 2002 and so many more before. The system is rigged. Don't get over it; get with it! You can't win in a rigged game. Stop playing. Change the game.
As that great American political sage, W. C. Fields put it, "There comes a time when we must seize the bull firmly by the tail and stare the situation squarely in the face." There's not enough space here to do more than summarize the growing mountain of evidence that supports the rigged game conclusion. The historic Conyers Committee is piling it up as we speak. It's easy to find. If you haven't already, google "vote fraud," citizen. Read it and weep. The incriminating facts are readily available all over the internet and the "alternative media."
Please, don't be like my friend, a staunch Kerry volunteer, who hasn't looked at the Ohio story because he reads the New York Times, watches the News Hour and dismisses all contrary data a priroi as the delusions of the "chattering class," "paranoid conspiracy theorists" and "whining losers." The fact is, he doesn't want to know. His whole political paradigm would fall apart like it did when he found out there's no Santa Claus.
But, to grasp the bull - even timorously - by the tail: the Voting Integrity Project ( http://www.usvip.org ) points to ten factors that must lead any fair person to question the "official" tally and insist upon an objective recount:
1. Systematic, Widespread Voting Machine
Irregularities
2. Highly Irregular Intervention by Federal Authorities
3. Impossible Vote Totals ( Some with a 1-in-250,000[,000] chance
of being accurate, according to expert statisticians! )
4. Openly Partisan Election Officials
5. Openly Partisan and Untrustworthy Vendors of Election Machinery
6. Unexplained Exit Poll Disparities ( Exit polls were correct
where there was a paper trail and incorrect (+5% for Bush) where
there was no paper trail. )
7. Unreliable and Inadequate Numbers of Voting Equipment in Poor
and Working Class (non-Republican) Areas
8. Anomalous and Atypical Voting Pattern Changes from 2000 to
2004
9. Uncounted Ballots, Double Un-matching Sets of Tally Tapes
and Uncooperative Officials in Many Areas
10. Widespread Illegal Voter Suppression Activities
Susan Truitt, of the Citizens Alliance for Secure Election ( http://www.caseohio.org ), one of the plaintiffs in one of the several suits being brought in Ohio to challenge the tally, has stated that, with just the verified irregularities and violations her organization has documented, the election plainly goes to Kerry. The 20 Ohio Electors who voted for Bush did so with zero legitimacy and a second Bush term based on their vote will be equally illegitimate. Think about that for a minute. If this is not a constitutional crisis, I don't know what is.
All power to Badnarik and Cobb and Arnebeck and Truitt and Fitrakis and Bonifaz and Conyers and Waters and Jackson and Curtis and Harris and all those brave citizens contesting the highly dubious tally in Ohio, Florida and elsewhere. With a judiciary stacked against them all the way to the same Supreme Court that perpetrated the first Bush coup in 2000, their chances of successfully litigating and reversing the outcome, having it recognized by the judiciary, the Congress, the corporate media - not to mention the Bush regime itself - will be a political accomplishment of miraculous proportions and will no doubt require a Ukraine-scale turnout of the citizenry to make it stick. May it be so!
However, failing a successful judicial, political, congressional and popular revolt, we are dealing, for the indefinite future, with a fascist, theocratic police state - and I use the terms precisely, not rhetorically. ("Fascism should more properly be called "corporatism,' since it is the marriage of government and corporate power," said Mussolini, who ought to know.) Making Howard Dean head of the DNC and commissioning George Lakoff to "reframe" the party's "message" and PR material would be a necessary, but hardly sufficient response.
A political system more crooked than a Las Vegas casino cannot qualify as a "democracy," much less as the "leader of the free world." And those who continue to play in it look to me like conscious or unconscious colluders, or just plain chumps. Until you accurately diagnose and acknowledge the disease, you cannot even begin to cure it.
And the disease we're dealing with - as originally diagnosed by that astute political physician Swami Beyondananda - is "Electile Dysfunction" complicated by advancing "Truth Decay."
The beginning of the cure, (necessary, but not sufficient), as prescribed by political healers, like the ladies of Code Pink and other groups, is enactment of a Voters' Bill of Rights: to wit:
1. Provide a Voter Verified Paper Trail
for Touch-Screen Voting Machines
2. Create Independent, Non-Partisan and Transparent Oversight
3. Celebrate Our Democracy: Election Day as a National Holiday!
4. Maximize Voter Access
5. Count Every Vote!
6. Re-enfranchise Ex-Felons
7. Implement Instant Runoff Voting (IRV)
8. Provide Public Financing for Elections and Equal Air-Time
9. Ensure Third Party Candidates Easier Access to the Ballot
and Debates
10. Abolish the Electoral College

My simple point is this - until a majority of progressive activists and intellectual opinion-makers drop the delusions and cop to the fact that we are playing in a game intentionally and adroitly rigged against us, we will not win, we will not govern, we will not be prepared to govern, because we will not deserve to govern. Good losers -- like John "Quick Concession" Kerry and the "professional losers" of the DNC -- will predictably go on losing. Just like the chain-smoking, gin-sipping, polyester-clad grandma pumping endless quarters into the slot machine.
"I don't have that much time here in Washington," Bush told a White House "economic summit" the other day. If this really is a nation of laws, he should have a lot less time than he thinks. ( Yes, citizens. We must dare to think such thoughts, if we are to be worthy of Jefferson, Franklin and Paine. )
There's a "Block Bush Constitutional Insurrection" rally and demo being organized by RedefeatBush.com from 10am - 4pm, January 6, at Upper Senate Park, Capitol Hill in Washington, D.C. when the electoral college vote is delivered to Congress. The Ohio recount will be done by then. We should have learned enough from the lawsuits and investigations to know the truth. Got democracy? See you there.

Violations as Congress Meets to Certify the Vote!
More than a month has passed since voters cast votes for the
President and Vice-President of the United States -- but every
day, more and more stories surface that call into question the
election's integrity. Machines broke down, counted backwards,
eliminated votes, and registered votes for the wrong candidate.
Democratic and African-American neighborhoods experienced by
far the longest lines on election day, the most vote spoilage,
the most elimination of provisional ballots, and the most victimization
by precinct manipulation. Four hundred thousand callers phoned
voter protection hotlines, with complaints ranging from absentee
ballots lost in the mail, to outright voter intimidation and
disenfranchisement. And partisan election officials with conflicts
of interest undermined voting rights in states from Ohio to Florida
to New Mexico. Even progressive Democrats on the House Judiciary
Committee have questioned the elections' legitimacy, in a series
of rigorous, painstakingly detailed letters documenting the unprecedented
extent and scope of vote suppression, available at http://www.house.gov/judiciary_democrats/.
How can we have confidence in American democracy when so many questions about this election remain unanswered? In addition to the longstanding issues subtly undermining democracy -- corporate domination of the two major parties, plurality elections, and corporate media bias - the recent election betrayed democratic principles overtly.
Despite the efforts of a few valiant members of Congress, most of our Senators and Representatives have ignored our pleas for serious investigation into the "irregularities" that surrounded the 2004 election. But one more opportunity remains for these government officials to stand for democracy.

On January 6, 2005, Congress will meet in joint session to certify the 2004 presidential election. On that day, if one member of the House and one member of the Senate object to the certification of the vote, then all members of Congress will finally discuss these issues. On January 6, 2001, not a single Senator would join with the Representatives who demanded an inquiry into the Florida recount. This year, let's make our Senators take a stand!

Time to Reach Out to Congress!
Remember, the President is not
selected by the electoral college, but by The Congress of the
United States when it meets on January 6th.
If the Democratic Party hangs together and fights this thing,
and if a couple of Republicans act on principle rather than on
naked power, Bush does not win.
Congressman Conyers and his colleagues among the House Judiciary Democrats and the Congressional Black Caucus, and former Presidential Candidate Rev. Jesse Jackson, have been carrying the fight for voting rights.
It is now time for other congresspersons and senators to work with them and support them in fully investigating the frauds that have been committed.
This is John Edwards's chance to redeem himself and remove the stench which Kerry attached to the election and to the Democratic Party by his unforgivable and inexplicable early concession, and it is a chance for Kerry to achieve at least a small measure of redemption.
It is now time for all of us to let our senators and congresspersons know, in no uncertain terms, how we feel about having the voting rights of Americans stripped away, and our country turned into a dicatorship of those who have the closest relationships with the voting machine manufacturers.
Please immediately, if you have not already done so, reach out to your senators and congressperson, and urge your friends and family to do likewise, to urge them to vote against the seating of the Ohio electors.

SAMPLE LETTER:
DEAR Congressman or Senator:
1. To ensure the legitimacy of the people apparently elected in the 2004 election, the House Judiciary Committee must do the following.
2. Openly hold hearings and investigate all cases of alleged voter fraud, for example those charged by Blackboxvoting.org.
3. Make sure that all recountable ballots are recounted, when requested. Do not allow stonewalling by secretaries of state with vested interest in one outcome.
4. Hold hearings on the numerous discrepancies between the pure exit polls (those not blended with vote tabulations) and the black box voting machines. Investigate the statistical studies by researchers at our top universities, showing prohibitively tiny probability that the discrepancies were due to the random chance associated with sampling error.
5. Investigate the numerous mistakes in vote counting reported this election, and the allegation that they are all in favor of Bush and against Kerry.
6. Do not certify the 2004 elections until these steps have been taken, and you have determined, in open and publicized hearings, that the apparent winners of the elections are indeed the winners. If the reverse is shown, do not certify the elections at all and let there be re-votes.
In addition, democracy and future elections must be safeguarded with the following legislation:
7. No black box voting. Every voter needs a verifiable, and recountable, paper trail. Democracies have never assumed that all black box controllers would be honest, always.
Open code on voting machines, to verify their honest programming. The trade secret excuse is silly at best, deceptive at worst. It is not difficult to program a computer to count and add. Touchscreens add complication, and potential for mistakes and more cheating, so tell vendors who want secret computer code because of their touchscreens to use pushbuttons, or paper.
8. Create minimum
standards for vendors of voting material. They must be free of
partisan activity, and their activities and programming must
be open to public viewing. How do you think we look to the world
and our citizens - when the owner of the (Diebold) black box
machines counting most of our un-recountable votes openly promised
to deliver
Ohio to George W. Bush?
It is your sacred duty to preserve democracy, and it is a higher goal than electing any particular party or ticket.

It is now a click away on the website of Women Progressive Activists Founded in January of 2000 in Ann Arbor, MI, to protest election theft, WPA has made election reform its central project. Among the several essential provisions within the Count Every Vote Act, a ban on political activity by elections officials addresses issues raised in Florida, Ohio--and Michigan--where Secretaries of State also chaired Elect Bush committees.
